Car Accident #1 ! D:

Hey guys,
This morning on my way to school I received a nice bump from behind ! :D My car didn't receive too much damage, however the other car's front bumper looked very unhappy.

Anyway, I'm just wondering who would be at fault in this situation (Note: Accident #1!);
Ok so we stopped at a red light, the other car was behind me and we're just chillin'. Then the light turns green, and I stall ^__________________________________^" My car didn't move forward or backwards (flat road), and yeh I'm not moving. So I wasn't in the middle of the intersection or past the line at all, just in the same spot :p. I flick the engine back on and then BANG, sounded really bad T__T I'm amazed at how hard the other person hit.

The other person is at fault right? I'm just worrying = = I haven't told my parents yet hohoho :p will when I get home though.

My car's rear bumper has a couple of dents, scratches and a couple of those interior clips holding the bumper on popped out, nothing major. Should I even bother telling my insurance to replace/fix this?

I got most of the details down; not sure if I'm missing anything.

damn, that guy is a tool... definitely not your fault... as far as the police is concerned unless u reversed into him its always the fault of the rear driver.

I wouldnt call ur insurance until u figure out wats happening with his because he should cover all the damage. If the accident is going 2 be reffered 2 either insurance it should be reported 2 the police (no matter how minor) within the first 48hours or otherwise the insurance company can refuse 2 cover you.

Id get in touch with him 2nite n see what action he has/will be taking n if he tries 2 fight it i suggest going 2 the police n reporting it, just 2 make sure u'll get covered.

you got all the details you needed to get. Next time note down his address just incase. Also note down details of the accident, possible witnesses, dates, times etc etc.

Also never say sorry in an accident. Could be used against you to say it was your fault etc etc.

With damage to your car being very minor, the other party may instead avoid increasing premiums and pay for the damage himself as its probably the same as the excess he's gonna be charged.

If so you'll need to head down to 3 smash repairers and get 3 quotes for the repairs. Then show it to the other party and then they can select the repairer or whatever. Go to a reputable smash repairer.

i suggest u tell ur insurence company and if uve got a panel beater friend they can fix up other stuff for you at the same time.(without riping the people off i mean adding a little bucks extra)

wells, why don't you get a quote for how much it is for to fix, and then tell him and get the dosh off him if he doesnt want to g through insurance.

similar thing happened to me, but i was at fault, was driving and he stopped outta no where, and i was not fully concentrating, and i hit into him at like 5km/ph. his rear bumper was cracked n shit, but my car was fine, no damage, except for a cracked number plate surrounding, gave him $200 and that was it.... (his car was a POS)

like type s stated hope u got the address and in this incident it is not you at fault, he should of left a certain range of min half car length of safety but as he didnt aint your fault, in this incident it should only cost a few hundred to fix so just make sure you make a police report just incase the guy makes a claim about you being at fault, and also see if you can negotiate a certain price to repair the damages on your vechile, go to a panel beater and you should be able to get a quote.
it will save the other party the excess fee as well just make sure you make a report with the cops before speaking to him in further detail about the current situation,
and probably make ur situation easier dont tell them that you stalled just tell them that the guy rammed up ur arse.

feeling relieved hahah, ermm I didn't get the address tho D: The other driver will most likely be contacting their insurance as it was a company car involved. So I'll just wait till their insurance company calls me and they can deal with my parents :p

Hey,
Firstly thanks to everyone for helping me :) I've learned a bit more as to what to do in a situation like this. Hopefully I won't have to face another one of these situations for a long long time.

Anyway, I'm not sure what's happening on the other end however, my dad has concluded that the damage on my car is too minimal and so it's not worth the hassle to get it fixed.

one thing ive learned, use your phone.
record the conversation of what happened, let them know that you're recording as evidence, tell em to state full name and address and ask what happened. thats the cold hard evidence that indisputable y0.

imo even though damage is minial, get a quote cos the yaris had once scratch and it was 400 bucks to fix.. so get the quote make them pay then use the money to buy the number plate.. HAHAHAHAHAH

Thats actually illegal so it wont be admissible if its taken to a court of law. Privacy laws require you to have the other parties consent when being recorded.

But you can probably just bluff that you have hard evidence and your gonna take him to court.

i agree to tell the insurance company and explain the situation...if you dont and later on they say its not their fault, that you reversed, there will be alot of headaches.
same type of situation happend to us, and it went all the way to litigation, court hearing blah blah, and this is over a year after the incident.
