View Full Version : Do I need RWC to sell my car?

Hi everyone,
i'm going to sell a car(CG5), and i was wondering if it is possible/legal to sell it without a RWC. what are the consequences of selling it without one?

the car is registered in Vic,

you can sell with no rwc
there is none
you just have to de rego your car
then sell as is with no rego

only thing is mite be easier or harder to sell
buyers can bargain with you more
or dont want to touch it

would it be okay to sell it without the RWC and get them to get it themselves? what'll happen if they don't get one? will we be fined?

nothing will happen it will all be fine as long as you fill out the disposal slip on the rego papers and hand it in once the car is out of your possession. then its up to them to get a rwc or not and its all out of your hands. but honestly selling a car without one usually means a car has problems or is even untrustworthy. in other words they add a lot of value.

on the transfer of registration form theres a section where it says

"how was the vehicle disposed of?"

and there are two options, through a LMCT and with a RWC.
do i just leave this blank? will vicroads accept it if its not filled in?

the car's fine, we just don't have the time to go get one with 6 days work and everything, lol

You can sell the car without RWC. That form you are filling out I assume is the transfer of ownership. You fill in all your parts, along with the new buyers details, take a photocopy for yourself.

Then give him the rest. When the buyer goes and gets his RWC, he'll fill in those details himself.

Basically, if you aren't organising RWC, then its entirely up to the buyer. You can organise RWC to make the sale more attractive but it isn't mandatory. The buyer MUST have a RWC to transfer the title to his name otherwise, Vicroads will NOT process it.

You will not get fined, you will not have any liability as a result of selling a car without a RWC.

So, congrats on the sale, get your money, give him the car, keys, and the paperwork with all parts filled, except the RWC section. Make sure you keep a copy of the paperwork (photocopy) in case he decides to be lazy and not transfer the ownership over (at which point, you will be getting all his infringement notices, rego renewals, etc). If that happens, go to Vicroads and show them the photocopy and they'll sort the rest out themselves.

u dont need to derego ur car to sell ur car with no roadworthy.

like toehrs have said...its much easier to sell if u have road worthy.. or u can drop the price a bit and let them worry about rwc.

we're hoping to not have to derego the car and to sell it without a RWC (cheaper and negotiable), and we're giving the option of selling it with a RWC but it might take a while for us to get one cuz we're really busy.

i just read somewhere that i might get fined for selling it without a RWC so i thought i'd ask just to make sure =)

just sell it without rwc if u want, but write down a contact/receipt that he has given you the cash for your car on xx date. and keep the pink copy of the transfer form.

This way u got proof that his taken the car and its not you speeding around if you do receive any infringement notices.

btw he can transfer the car into his name without a rwc but has 28 days to after that date to get one.

expect to be low balled alot if u sell it without rego as some shops theyd take it to will no doubt charge an arm and a leg, lol

best bet it to fix what needs fixing and get a road worthy, less hassels, more money in the wallet

by dropping the price seriously youre basically giving it away without a roadworthy, for example Ive bought eg sedan vti's without a roady for under 500 due to that alone and knowing it'd take at least a grand to get it up to some from of passability lol

I think a written receipt will do. The receipt should just say you (seller) have sold the car to (buyer) of (address) for the of ($price)
include details such as each others license numbers, address and good idea to date it and keep a copy each.

if u do get pulled up for advertising your car, like for example

"call if interested" on the back of a car

a cop sees it, flags u over, u dont have that blue form in vision, u cop a good fine :)

there should be as most will never be able to be fixed up to meet requirements (cheaply anyhow, lol)

and if they do its usually thanks to a dodgey guy who doesnt check much lol

which concludes why I hate imported Nissans as many ppl go that route, where they find a dodgy mech who doesnt give a shit and stamps accordingly

fk if I was in the courts I would inforce huge penalties for such actions lol

To transfer a registered vehicle, a current Victorian Certificate of Roadworthiness (RWC) is generally required however some exemptions are available.

Exemptions
Transfers may be exempt from particular requirements. Some common exemptions are:

•trailers under 4.5 tonnes GVM are exempt from a Certificate of Roadworthiness and motor vehicle duty
•transfer between domestic partners can be exempt from Certificate of Roadworthiness and motor vehicle duty
•recreational motor cycles are exempt from Certificate of Roadworthiness
•beneficiaries of deceased estates with will or without will may be exempt from transfer fees and/or Certificate of Roadworthiness and/or motor vehicle duty

A person who sells a registered vehicle is required to:


provide the buyer with a RWC issued not more than 30 days before the date of sale
•complete a vehicle registration transfer form with the buyer and keep a copy for their own records

A person who buys a registered vehicle is required to:

•complete the vehicle registration transfer form with the seller
•submit to VicRoads within 14 days of the sale the completed transfer form, RWC and fees

you don't need to de-rego a car to sell it without rwc.
just post it up as $price w/o rwc.
also each state sells their car accordingly to their state rules.

Better off getting an rwc. i think its only a bit over a hundred from racq provided that it is road worthy.
transfer of rego needs a rwc and the current rego certificatee otherwise they have to buy it and re register it which is more of a hassle i think.
much worth getting the rwc and selling at a higher price.

It's illegal (read $375 fine) to sell or advertise a registered car without a Safety Certificate. They can't actually transfer the registration without.

Your only choice is to sell it completely unregistered (hand in plates) or registered with the Safety Certificate (RWC). You can of course sell it and then unregister it, but you can't hand it over with registration.

If it's unregistered, they have to obtain their own RWC and then start a new registration in which they'll be issued with new plates.

yes it will be ok to sell a car with no rwc and get the buyer to get it themselves..

Last year i bought a car without a rwc and i just had to deal with him and made an agreement that im purchasing his car without a rwc certificate. He also pointed out what is not roadworthy. I also couldn't transfer the name of the car to my name since the car is not roadworthy.

So as long as you let the buyer know what is not roadworthy on your car and should be done will be really helpful to the buyer!
