So tonight im driving along pittwater road at around 9 with my gf and a mate, see and RBT pullover and stop get breath tested and then get ready to go when the cop comes over and tells me to rev the car to the 3k....i was like ahh what, but ok i will, so i do it then back off and he says quote " son your car is of an illegal sound level",
So he makes me wait on the side of the road while he goes over it looking through the whole car, he then finally settles to issuing me a notice saying to report to the DECC for a check.
The thing that annoys me is that he did not have the equipment to test the noise of the car, he just believed it to be loud even though we were on a main road and no i was not drivng like an idiot, he then tried to get me for not having original taillights.

lol dude, massive crackdown on the northern beaches... some jdmst guys got owned hard lol.
I was there with BURST and this highway patrol was having 2nd thoughts on pulling us both over... luckily there was traffic beeping at him so he just left it.

u can even get a defect letter sent to you if they think your car is too loud and you will need to goto the EPA to get it cleared.
THey apparently don't need to test you on the spot anymore

thats bs, he cant give a defect if he thinks its too loud can he, should show us numbers or digits to prove that it is to loud as proof like RBT's, wen ur busted drink drivin they show u how much u had, souldnt it be the same?

Yes he can! The onus is not on the Police to prove you're too loud, it's on you to show you're not. Therefore there is no requirement to measure anything, including height, loudness, etc. If they "think" you're too low or too loud, then you will be required, by issuance of a notice, to take your car to an AVIS and get the notice cleared. But this will cost me time and money, you say. Yes it will but there's nothing you can do about it except make sure you now the limits of the law, your rights, and keep your car legal.

damn, tough luck. avoid the big roads during prime cop hours. my brother got done in melb. on monash hwy and had a letter sent home to him, lucky it wasn't a pullover. testpipe, game over. $10000 i heard. and i was the one driving! lol.

Yes they can...its just the matter you need to proof your car is not illegal....not for them to proof your car is illegal.......whenever they have any questions about ur your car......they can give you the defect notice and get ur car check....thats the power they have and thats why they have the defect system....

You are right......and the best advice is to keep your car legal.....loud not equal to cool.....I see too many LOUD cars that dun go at all.....lol.....

I got done wif my other car, epa'd.
I got a notice'd issued in the mail, cop nevah pulled me up for it.
If u fink u'll fail the test, u got ur stock exhaust still?

I'm not gonna lie my car does make a bit of a noise, though only when its being kicked in the guts, it's just the way the cop did it, pulled me over breath test then went round the back looked at the tail lights went they don't apply with Australian standards, then looked down and went ohh i bet that exhaust is loud.
So he made me rev it to 3k then back off and he said that the back off was the loudest bit and that according to him it was to loud and able to be defected, i was like ahh ok first cop to say that but whatever.
So issued with a notice and should receive letter in the mail to go get it checked, anybody know how much it costs to go get it checked.
P.S luckily i do have the stock exhaust so i can put that back on, not that i think the one on at the moment breaks 90DB.

if you get epa'd with your current exhaust can you just put on the silencer and pass? or still have to change to your stock exhaust.

If you know of a workshop with a sound level meter, get it measured. If it is below 90 DB, then I would get it inspected with the aftermarket exhaust. The report should note that you have an aftermarket exhaust and that it is below 90 DB. Keep that with you in the car in case another cop pulls you over in the future. At least you have some evidence that you have been sent to test it before and passed. It's not a guarantee you won't get defected again, but it is 1/2 a chance that you might get away without one.

When i did the text i blew 97db on the blow off..
I put the stock bak on then the cannon went bak on and done! :D

But your report will say "stock exhaust" and < 90DB, so there is a chance a picky cop will pick on since your cannon is not stock. Hehehe :)

Found this on another website: 90 decibels, equivalent to a police whistle, heavy traffic, truck traffic, noisy home appliances subway-rail train, pneumatic drill [or hammer] at one meter, walk-man ear phone [average volume], rock drill at 100 feet, some motorcycles at 25 feet, shouted conversation.

went to HRC today and the exhaust was a little loud definitely over 100db, so the stock one is on and my god it is depressing, its so quiet.

You can be sent a EPA notice if 3 members of the public write to police or EPA stating your car is too loud, or if a cop dobs you in.
This is why I run a silencer on my exhaust.

how do these laws work in relation to standard cars? like im sure a GT3 porsche or some ferrari's etc are quite loud when accelerating hard, are these all tuned to 90db to be compliant here or are standard louder cars excepted?
and if everyone is being measured at the exhaust, what if other parts of your engine are louder, or sounds?

guys every single one of you are missing the point as i've outlined this a few times in regards to DECC.
it does not matter if the police officer does not have the 'proper' equipment since if your car is legal then the DECC centre will simply pass you should your exhaust pass. SIMPLE!
Varex mufflers and all other adjustable muffling devices... good luck, instant defect unless engineered/adr approved. and i think you'll find it very hard these days for a workshop to willingly 'engineer' a loud exhaust.
Putting your stock exhaust back in... yeah cool... make sure you don't put your loud shit back on. Because they take a picture of your engine bay and entire undercarriage and send it to the DECC along with your 'pass' report if you pass.
Get caught again and suffer a huge fine and possible impound nad license cancellation... may as well sell your car and start over.
Am i being a dickhead? no... i went through the entire process and read all the documents, processes and warnings supplied.

Here mate... have a good read of it especially the checklist. make it as close to stock as possible:

IF you do not think your exhaust is overly loud you MAY pass if you pay ~$100 to have a mid-muffler installed. It is NOT a resonator, ask any competent exhaust shop to have a mid-muffler fitted (My recommendation is Hakan from Northmead Exhausts).
This is because I spent almost another $1000 getting my exhaust back to stock (except extractors) and i was still hitting 93dB even with the stock muffler/cat
Having a mid-muffler fitted to my exhaust system reduced ~12dB from my twin-loop system which was fitted a year after i passed the DECC inspection
Like i've mentioned in other posts, i don't think anyone here realises really how quiet 90dB is... so much that even a extractor change will put you over.... i ended up passing with 84dB and my engine wanted to die after it all... and i passed on the 5th go... and yes you have to pay $60.50 every time you go for a test....

yes but if you actually did get sent to a DECC centre, they don't just check for noise, they check for emissions equipment (or anything that affects emissions) which is everything else in the checklist.
i wanted to smash myself in the balls coz it was that bad.
