So yesterday I rear ended a lady, with minor damages.
I told her if we could settle this without insurance as I'm on third party and my excess is approx. $1500 which she agreed to.

So i got a call a couple hours later from her son, following up the situation and telling me that she would like to go through HER insurance as she needs her car everyday and AAMI has free car hire, whiich i was cool with.

I got a call today from AAMI saying the lady lodged her claim and so on and after everything I asked her what I would be paying for, the actual repair bill or her excess, which she replied, "You would be liable to pay for the repair bill".
She sounded pretty lost and i was late to class so I said ok and hung up.

Now...after thinking about it, why would I be paying for the repair bill? Isn't that what the insurance is for? They're getting the excess from the lady and also getting me to pay for the repair bill? Must be a mistake right?
I'm pretty sure I'm suppose to only pay for the excess...

Another thing is, seeing as she's on comprehensive insurance and she made the claim, would that mean that my car gets fixed also? Or would they just fix hers as it's still my fault?

Any advice/help would be appreciated.

u dont have to pay for the repair bill, only the excess and thats it. She has full comp to cover herself and the person SHE crashes...so in other words ur in the wrong so u dont get covered unless YOU have full comp insurance. hope this helps

normally a rear end your at fault unless there is some unusual reason your not.

If she wants you to pay for the damage there are 2 ways.
1) you pay the bill and get her to write down that you have paid the repairs in full once done.
2) if you have full comprehensive and you its worth your while to pay the excess, you tell her your policy number and make the claim through your insurance and they pay her out.

She can only have payment from you or your insurance, but the choice is up to you which way you want to pay her

Yeh my fault no doubt.

The reason why I wanted to do this without insurance was because I have a mate that owns a spray painting business and could of done it for $200-$300...which would probably be less than her excess.

But good to hear that I only have to pay excess though.

yeah be careful, my gf had the same issue with a dodgey guy, who seemed clueless, but then ended up trying to claim through his insurance to chase us for repairs.
He was claiming everything under the sun, the total cost was like $10k he was claiming for a small ding to his rear.

Ended up getting a solicitor to write back to his insurance and set things straight. In the end the insurance didn't come after me for any costs at all, funny enough.

If you dont want to go through your insurance company then you are liable for the damage to the vehicle...

the reason why this is, is because if you were to pay her excess, and her insurer were to repair the damage to her car, she would lose her no-claim bonus... which im sure she does not want to do...

AAMI, as her insurer, will try and recover the cost from somewhere when their client is not at fault, otherwise they need to take the excess off their client, and penalise their client for claiming without an ability to recover the costs of their client damage...

If the quote for her damage is more than your excess ($1500), you may as well claim through your insurer... if it is less, than you may as well pay the damage bill yourself...

If you do not have the money, i would ask them if it is possible to fix them up on some sort of payment plan... if they take you to court they will force you to pay the full amount...

Knowing from other friends experiences, the prices to fix minor scratching are way overpriced.

Try to find an adult (over 25) there access is usually fixed below $800 (in some cases $400)

Get them to take the blame but u pay the excess..

Yeah, when I had my first car ('86 corolla) I rear-ended some woman in a big Toyota Camry. My car was a write-off so I just gave her my details for insurance and we went separate ways.

When I told my parents they thought about it for a while and realised that I wasn't insured! They'd been nice enough to give me the family hand-me-down car, pay my first year rego/insurance/uni books etc but had ultimately forgotten to add me to the insurance list on the car (I was 18 and had no idea about these things...).

So I basically found out I wasn't insured and the damage to her car was $4000 and mine was a write-off, but fortunately we bent the story so that my dad was at fault and that dropped the $4000 to $500 for his excess.
Then I went and bout my EH Civic VTi :D

The insurer will go simply on cost... depending on who the person is insured with

Ok so this is how it is,

I'm paying for her repair bill and not excess.
This is because she's not paying an excess because she's not at fault even though she did the claim.
I can't use my mate cause they're not AAMI approved (even though the lady was fine with me using him to repair if it was allowed).
Just hoping I don't get some stupid overpriced quote from their panel beaters to respray a rear bar.

I was quoted $200 per panel for a good respray from an independent worker not including paint costs, but is there any structural damage? My $4000 damage quote from the car I rear-ended was pretty much because I'd rooted the back-end structure of the car :(

Not structural damage whatsoever to hers, just some scratches.
The worse i got was a little dent in the bonnet.

Hopefully under $1000 ey.
