Now my mate was heading south, turning right into a car wash on Canterbury Road, and when he looked there were no other cars coming, so he went, but as his car his going up slowly up the ramp, as his going up, he can see another car coming, and thinking the guy has enough time to brake, my mate continues going up, putting up his hand, gesturing, sorry cause im going slow up the ramp, the other car contiunes rams my mate in the rear, my mate loses control, crashes his front into a pole, now it held up traffic on the road, so cops came bla bla and the towie came, they said the cars most probably written off and so they towed the car to the car yard.
Now i dont know why my mate couldn't tow it back to his house, but im wondering
1) can he go to the car yard and swap back his parts? or even tow it back to his house or something?
2) if worse comes to worse, will he have to option to buy back his car, or will he have to wait and come to the day of the auction and bid is back?
What options does he have? they go its most likely that he is at fault because he was turning right.

Now to answer you additional questions

Insurance covers tow cost from accident scene to holding yard or assessment centre only, otherwise towie aint gonna get paid, thats why.

I take it his car's lowered? if it is or any suspension mod done, just to be safe make sure you skip this bit when calling the insurance company... or they may deem the lowered suspension contributed to the accident.

Once the car is in being assessed, your friend needs to speak with assessor, to to and swap out the parts, if they agree.
Else he has to line up at Manheim Fowles or something to auction it back.

1. he cant once in the holding yard, legally cant change anything on the vehicle but take his belongings, once the insurance company has decided on the options, than he can choose what ever they say to him...
2. If its deemed as a write off, he will have the option to buy it back through the insurance company and they deduct it from what ever they give back or else it will either be scraped depending on the damage or sent into a auction
Insurance will claim that for this situation that the guy behind shoulda left enough room for a safe brake distance... and since the guy smacked into him, chances are the guy behind will either pay for the repairs or total lost... So really ur mate should b in the clear here...

Insurance dont care who smacked into who.
and it's not a rear end collision here, it's more of a T-bone if anything.
Road rule says if you are making a right turn against traffic you give way to traffic going straight, Unless there is a solid, independent proof (nothing short of a video recording really) the other car is too far away and should have stopped, insruacen is not going to bother arguing liability... "You are turning againest traffic, he's travelling straight down the main road and you got hit on the SIDE, case closed." Insurance's got this attitude cause thats whats gonna happen in court...
Whether you can buy the wreck back from the insurer direct depends on the insurance company, many insurance companies now days dont allow you to buy back from them direct anymore (eg: AAMI, GIO), because they'd they more money back if it's auctioned.
Since insurance wont be paying extra for the mods, you should be given the option to change he parts out. Since they are only buying the "standard" car off you.

I reckon your friend is up sh!t creek.
I don't know what car wash it was, but exactly how slow was he going up the ramp? That a car which 'wasn't coming' should suddenly appear and clean him up either means that the other guy was speeding horrendously or that your friend didn't allow enough time to cross over the oncoming lanes. Either way, he got hit turning right in front of oncoming traffic, whether the other bloke was speeding or not your friend is technically at fault.
Also he has stated in the other thread that he never informed his insurance company of his CAI, rims, coilovers and camber kits so I wouldn't be surprised if his insurance is void altogether should he tell them that 'he was driving up the ramp slowly' due to his mods.

First of all those Asian legs dun even look good, looks like twigs. And secondly if your friend went to an auto elec and got his headlights adjusted properly none of this would have happened.

If the car is modded in anyway and the insurance company hasn't signed off on it and the mods are not Road Worthy then he will not be covered.

And same thing happened to me and I was able to swap over all mods before my car went to the aami inspections station..
I spoke with the insurance company AAMI and was told any item i remove must be replaced back with an item aslong as it is in full working order so then I was able to call the towie and organize a time to remove stuff that was mine I.E head unit, suspension, intake, headers and seats :) Aslong as I replace them with the stock parts

wow... what a mine field... a prime axample why if you are going to mod your car, make sure your insurer knows about it... dont even know where to start in terms of advice for the rest of it... good luck

For the record my insurer knew about the mods however they cover cost of my ride did not go any higher in value lol so why tell the insurance?

So they don't use it as an excuse to bend you over when you need them to pay for something.

^ precisely... and it IS a conception created by really bad scenario's, BUT they do have the ability to ream you under what is called "Duty of Disclosure" under the relevant FSR acts and Insurance Code of Conduct...
