View Full Version : Buyer claiming car unrwc when i sold it

charliebrown

Long story short, i sold my EG with rwc. now the buyer calls me 5 days after saying the wipers are broken and not his fault etc, that i sold the car to him in an unroadworthy condition... the workshop passed rwc so clearly it was working then. and it was working as i drove the car for 2 weeks AFTER getting rwc up until buyer picked up the car

what can i do about this? its fukn bullshit. do i have to prove it was working when he picked up the car and that it broke in his possession?

you do nothing about this, its his car. Unless he hasn't paid the full amount just walk away. Its his fault for not inspecting the car well enough.

Noob forum.

If you sold it with a valid rwc. And the buyer paid in full, drove off, and has xferred rego. Then dont bother. It was up to him to inspect the car when buying. Its his car now. Not your problem.

I was faced with same situation, bought a car and the hubs ended up needing replacing after not even a week of driving

I didn't message the seller, just dealt with it

Not really your issue hey. You got the rwc and its now in his name.

You dont do nothing.

Tell him the car was RWC when you checked it and he checked the car as is and bought it.

If the car had a scratch adn he came back after buying it and complained would you refund the money?

Fock no.

Same thing with the wiper.

Anyways now we know CB garage is dodgy for passing RWC with non working wipers.

Once the car's been paid for and rego's been transferred, so long as it's a private sale the seller has no obligations at all.

Unless there was some written agreement to do with what happened, you dont do anything.

And even if you did, there'd be no proof of what actually happened, and IF it does go to court (for a fkn wiper. lmzooo), it'd be the battle of bullshit artists.

Were they Spoon wipers CB?

PHO

Oh actually. Rego doesn't even have to be xfered. As soon as the vicroads papers are signed, its his car.

Unless you got a dodgy RWC, you're entirely in the clear.

Wipers not working? Both? More than likely he blew a fuse. Tell him to give you his bank details so you can transfer the money to fix the issue. Then transfer him 20 cents...

HAHAHA +1! But yeah Pete its not your fault dude, he prob wants an excuse to get back at you. Just leave it as is, as others said its his fault for not inspecting properly i had the same issue with my old ej8. He can't do much about it, i mean asif he'd get police or anything involved hahaha

If his really bothering you, take him to the place where you got your RWC and let the mechanic prove that the car is in rwc condition. Then slap him in the face haha

Even if he got police involved, he inspected the car, signed for the car sold as is, picks up the car, its over. Normally when anything is missing or needs to be done, I will address it in the contract of sale, that I type up myself, print 2 copies, and get both parties to sign with 1-2 witnesses to sign, done thats it.

He can't do you in for anything unless he has that sort of written material bro.

Dude don't worry about it just don't do anything

It's the buyers fault for not checking the wipers during inspection and the buyer can't really do anything about it

worst case he takes you to court over a wiper on a 20yo civic but that wouldn't happen LOL

There is a latin expression. Caveat Emptor. It means let the buyer beware.
You sold a second hand vehicle in "as is" condition. You have no obligation to fix anything.
That is the new owners responsibility.

is there an echo in here? just read the same thing 20 times lmzo thx for replies

the guys issue isnt the fact that it passed RWC, but that the car was unrwc when he took it. i know for a fact the wipers were working as i drove them in rainy day just before he paid up full and took the car. have a feeling hes not gonna let it go until i fork out to fix the wipers or some shit

I hate it when poeple buy a 2nd hand car and act like it should be brand new. oh theres a little dent here. And a little scratch. Blah Blah Blah i want to pay less money because of these reasons. You want a perfect condition car. buy one brand new.
I tell him to F himself. When ever you buy a car you look over it yourself and see if you happy with it. As soon as 1 person submits the rego papers the car is transferd. As soon as you have the money its not your problem.

If you buy a dud its your own fault. if you not confident looking over a car, Take a mate in the no or take it to a mechanic. Or buy from a dealer and spend twice as much for peace of mind!

what's wrong with my subaru? nothings wrong with my subaru...

the list above was the list for my EM1.

LOL CB Spec, feel sorry for you brah. Same shit happened to me... But as you can so it wasn't just window wipers. The new owner wanted to take both me and RWC place to court over this.

i 1: Did not want to go to court over this and 2: Having my RWC place hate me.

I spoke to my RWC place and worked something out as 80% of the stuff on the list was NOT my fault. i basically paid for parts and he did the labour.

In your situation i would just pay for the window wipers and **** him off, not worth it. OR just ignore text and hope that he ****s off. End of the day, you're not in the wrong, RWC place is.

tell him your statutory private used car sales warranty has a 5 day cooling off period, and he contacted you just in time.
but to claim his warranty, he has to pay you a excess off $600 to start any repairs and also if he is under 25 theres a $350 excess too

Alright so i called the workshop, they said not their fault, nothing they can do.

told buyer that, now hes saying that the wipers were fukd 100% before they got the car, even though they didnt check and i know for a fact it was fully functional as it was raining just before they took the car.

reckon it broke and hes tryin to get out of payin for it by hassling me?
