i am in VIC!i was sell my car to somebody who live in NSW for 5 months ago!!! and today that guy just ring me said that car can't registration in NSW!!how come that car can't get the registration in NSW? and what can that guy can do?:confused: i have check my car in VICROADS b4 i sell it they say nothing wrong with my car!
i have already go to VICROADS to ask .... they say that car haven't pay rego for 4 months then its canceled already no more info in VICROADS database.
pls help me!! because that guy disturb me!and that guy said i tell a lie for him to buy my car!!how come?!as i say my car is nothing wrong in VIC! and when he inspect the car ... he also say "NO PROBLEMS OF IT"!!and i already told him i don't know this car can be registration in NSW or not and he say "NO PROBLEMS"also when he buy the car i have already tell him ask RTA b4 he come to VIC to inspect the car.

Your post is very difficult to read due to your grammer, but I think I extrapolated these facts:
You sold your car five months ago to an interstate buyer. At the time of the sale you got a roadworthy and went to vicroads to make sure that it complies with all the legalities. Now the purchaser has turned around and claims the car cant be registered in his state.
Is this correct?
Now while I am no legal advisor, I would have thought that unless you misrepresented yourself (by saying that it could be registered interstate when it couldnt) that he wouldnt have had much of a strong defence as you would have signed a legal contract. My personal suggestion would be to speak with a legal advisor and make sure you document all future communications with the buyer.

Anyway, you had your car registered in VIC and was fine. As far as you knew your car was fine. When you buy a car privately there is no warranty or anything so he has nothing on you. You could buy the car back off him if you want but I wouldnt. If he threatens you go to the police. Simple :-)

When you sell a vehicle it's meant to have a safety certificate from the state that its being sold in.
If you've done this then you have done no wrong. If you've sold a car without a Safety Certificate then you haven't followed your obligations as a seller.
I suggest that you pull up or the paper records from the sale of the car (which you should have kept) and let him know that at the time of sale the car was roadworthy as stated by the road worthy certificate.
Also, remember that its been 5 months. How come they didn't try to register the car sooner?? Sounds dodgey.
Further more, if this person starts to threaten you, take it to the police. If you know yourself that you've followed the correct procedures in selling the car there is nothing that he can do to you so you should feel safe in approaching the authorites about the matter.

in NSW when u sell a car, u give the RTA a notice of disposal slip saying that u either sold the car or got rid of it so its no longer under your registration or posession. I dont know what thw VICROADS equivalent is, but did you even do that? If so, you technically shouldn't be liable for the fine.
Also, I dont know what the circumstances on this car is, but what are the reasons the RTA gave him for it not being registerable? Does he need to get it blue slipped & inspected again before getting a pink slip? Has he even consulted the RTA as to what he should do to get it registered in NSW?
This guy seems awfully suss, but if you've done everything properly, given vicroads notice that you have sold the car and is no longer your posession, and given him all the docos he needs as stated by other members above, then you should have no liability for anything he does from that point on.

i dont get some people.
Once the money has been handed over and the new owner has taken ownership of the vehicle its his/her responsibility. As you mentioned the guy had plenty of chances to see if he could register the car in nsw. Just tell him there is nothing you can do and for him to piss off.
Btw is the car modified. could be a reason why he cant register here in nsw?

"rims,lip kit,coilover" as too low so i catch by police then i change back the original springs and get the RWC! so thats mean its all right! after that i haven't change back to coilover! after 2 months i sold the car .. and i was ask him to do a RWC for the car but he say no need because he drive the car back to NSW! he will do everythings in NSW!

that vehicle registration transfer form has a date on it, SPECIFICALLY so that from that date onwards, you will NOT receive a fine relating to the illegal use of that motor vehicle. As long as you FILLED IT IN PROPERLY, and sent YOUR copy, then VICROADS SHOULD be looking after you. I can appreciate you dont have the best english and may have some trouble dealing with VICROADS. If you need someone to give them a ring and sort things out, let me know via PM.

If you didnt send you side of the form to vicroads, and the seller hasnt lodged his, than you are in a bit of a pickle.

also as it's out of rego, your rwc has expired and it's being transfered to his name it will need to get a new rwc regardless. i can't see any reason why he can't get it registered in nsw unless it's unroadworthy.
when i sold my bike to a guy in WA all i had to do was issue a receipt and then he had to get rwc and register it

Perhaps RTA isn't letting him rego it because there's an outstanding fine on it (the one your received)??
Like bungsai said, when you sell a car:
- YOU needed to have a current RWC (ie one done within 30 days of selling the car)
- YOU BOTH needed to fill out the Vehicle Registration Transfer form that bungsai posted up
- THE BUYER needed go to the RTA and sort out a new registration as the car was previously registered interstate.

just ring that guy ... he say RTA's reason of that car can't registration is "written-off" in RTA's database!!!Shit how come?! i bought this car from 1 owner who is in VIC! how come RTA's database have this car's info?
as i say when i bought it i also get a RWC and transfer form to VICROADS! nothing happen of this car!

Fill up the back of the form with a statuatory declaration that you were not the driver of the car and put the buyer's details down. You need a Justice of Peace to sign the form too. Mail it to the infringement processing bureau so you don't get fined.

When the buyer transfers registration he pays a transfer fee. Which is calculated with by of the ammount you sold it for plus stamp duty. Seems like he neglected to go to his road authority to advise them of the change.

i know that but that buyer is from NSW and i am in VIC! and today i just ring that guy ask him the reason Why the car can't get the registration NSW and he say RTA say the car is "written-off" in RTA's database!! .. so i really really don't know whats going on!!

That's nonsense. Definitely go in there, ask to speak to a manager and tell them the buyer's interstate and not it's not easy to get him there.
On the other hand, I'd probably just tell the buyer to figure out what needs to be done and tell him off for not sorting it out.

sounds like a rebirth buddy, maybe the "compliance" plates were originally from a write-off civic from NSW, put on a stolen car and then sold in VIC
Vic wouldnt know about it because there are no links to the databases from other states, ie vic roads and RTA in NSW

If he lives in NSW, he must have an NSW license. Not a Vic license. And the car has to be NSW registered. I think he will only get 2 months before he has to change back to an NSW registration and license if he did it your way.

Depends. People who have an interstate license but living in NSW are able to purchase NSW cars and obtain NSW registration without having to change over licenses. The RTA will issue an 'identity number' to the individual (which is basically the equivalent of our drivers license number. This can happen if a person from interstate is living in NSW but unsure if they will be staying here permanently. Mate of mine did that when he bought his car.
civicVI - if you were unaware of the status of the car, it's the buyers fault really. He should have conducted a REVS check to see if the car was on the database (as having money owed on it or been written off).
He needs to figure out what type of write-off it is:
a) statutory write-off- can't be registered, only can be sold as parts
b) repairable write-off - can be fixed up.

Yeah I get you. REVS check in NSW only covers vehicles written-off in NSW. Prospective buyer should have checked both the VIC (where he was buying the car from) and NSW (where he wanted to register the car) registers. His fault for not looking that up.

If you have a problem with it, take it to court.

ok! today i just go to vicroads with that buyer to found out the problems of this car! the staff of vicroads just told me this car in the database shown write-off can't registration anywhere! and i ask him how come? he just say he don't know(all of the answer of him is "i don't know")! at the moment i am f**king angry then i just ask him let me talk with the manager because you don't know everythings!
then i talk with the manager tell her all the story of this car!the manager told me this car in vicroads record shown is write-off. and the day of write-off is 2001 at NSW!! then i ask her how come? i have own this car for 2 years! then i just told her when i bought this car at 2004 and i have check the record from vicroads ... they say nothing happen with this car at 2004! thats mean i am also the victim.the first owner deceived me-he lied about this car!!!!and she told me they got this record from the insurance company at 2007! after that she say this car can't registration in NSW ... but in VIC is fine. but the buyer need to make a RWC and VIV certificate to let Vicroads inspect ... if all pass then this car can get registration!
did the insurance company make a mistake? and WTF with vicroads!
