if i get rear ended by someone, on the same lane, is tehre any chance they could put the blame on me ? i have a statement from them that reads

"i had a car accident with (rego plate) at 1:22PM on the cnr of so and so place. the car infront of me braked quickly." and then he signed it.

discuss.

car behind is responsibile to keep a good distance...

yes..the person behind should leave safe braking distance if u were to slam on brakes for whatever reason.

The guy could take you to court on his 'theory' and would end up paying not only his fine, but also both yours and his Legal costs.

There is no such thing as braking too quickly, you brake accordingly to the situation. Tell him - If you braked too quick it means his too slow to react and slam his brakes <--- yes that comment is just as stupid as his accusation! his meant to keep enough distance between the front of his car and back of your car to safely come to a stop.

Tell him you'll try give him warning next time his behind you....

had a friend who got rear ended and yeah the guy behind was at fault they said =D ( as everyone has said earlier, the guy behind didn't keep a safe braking distance).

get quotes for the guy/ guys insurance company. They will then inform of which place to fix @ .
Do not do anything until you get quotes from atleast 2 different places.

if you dont want to go thru insurance just agree with the guy that ur going to get 2-3 quotes n that ull be picking the best and fairest of them.
Then hell pay you out for it. ;)

i think the key part here is who made the first police statement? that and have you got any witnesses?
if they dont agree, threaten to go to court and have a police drug test performed (usually gets them paying)

now ? from previous experience, theres no need to get one unless either vehicle is not drivable or someone is injured..

well, if you dont make a police statement, then they can say whatever they want and there's little you can do about it without a witness.

Zico, i've been in insurance for 7 years, and the police wont always give you a decision on who is at fault, and it doesn't mean a thing to insurance companies.

As far as any insurer is involved, if you rear end someone, you are at fault, if you got any other questions, hit me up

yehh. just spoke to police about it . they told me they have nothign to do with it and they will just take a note and give me an event number. thats it. they also mentioned they do not decide who is at fault. so you're spot on !

Back end of yours is damaged and the front end of theirs is damaged. It couldn't have happened any differently. lol

i've seen a parked car reverse into a moving one before, and the blame was split 50/50

the other car had a bullbar. no damage done to theirs.
mine only had damage to the tail gate which i will be replacing with another one. no damage done elsewhere.. =/

off too dalmar smash repairs, queen st smash and some other good quality smash repairers. haha

lol I always head off to Marbo if you want a nice expensive quote :P

You should know the one in condel park about 5minutes from Queen St.

Definately not your fault so don't sweat it :)

Just for future reference even if you have a minor accident you still have to ring the accident hotline to report and get an event number as the police don't come to accidents unless someone has to be towed or the damage is over 5gs.
