Was wondering if anyone knows or can give me a little advice.

I got defected for my intake and was issued with a defect notice and a fine aswell to go with it. However the location where i was caught stated on both documents do not match up. So if they're both for the same thing it should be the same correct?

Also i've heard somewhere awhile ago..something to do with if documents have errors in it i have a case?

if the locations do not match up, then they'll require further evidence to prove that they have defected the right vehicle. but in the end, it doesnt really matter, if you leave the reason for the defect still in your car when you petition it in court, and they request to have the vehicle inspected to verify it is still defectable, then there would be no point in arguing the case. unless you've got evidence to suggest that your intake was actually legal, no point in arguing the case. its a matter of what, not where.

i've already fixed it up and is no longer defective.

hrmm however to prove they have defected the right vechicle its not that ahrd is it? has my number plate etc is all written on both documents..only the locations dont match up.

well if you've got someone that can vouch that you werent at either of the locations, or that you werent at the location that mattered (location brought up as evidence in court), then they may withdraw the case. emphasis on may, as youll be trying to bullshit the system and make yourself an enemy of the police.

i got defected recently for exhaust being too loud and rims too big....was only a minor defect and had to pay $211 in fines...no demerit points were given fortunately

nuh i dont to take it to court..but would like the fine to be cancelled if possible..it was 200$ i thought it was only 79$ as stated by another officer a couple months back.

I got defected for my pod filter aswell... didnt get a fine though or lose any points..:p

they won't cancel the fine, they will ask you to goto local traffic court if you have an issue. The only one who has the power to change a fine is the sargent in charge at the police station. I've gone down that path already and its bullshit, they got my details wrong and instead of cancelling the defect they just wrote on it and corrected it.

They really look after their own, don't expect any justice when it comes to one of their boy's incompetence. I even tried to take it up with the policing ombudsman, no luck either

I'll tell you now unless you have evidence and your 100% sure or have the time to fight it, its not worth the trouble. i ended up letting go cos the $88 fine wasn't worth me going to court for the day.

Everyone gets defect for everything....
Doesnt that mean any car with a cannon gets a defect pretty much? Because all cannons are loud!

yeah thats why i didnt want to bring it back to the station because they're just going to change it.

my cannon has a silencer so i dont have to worry about loudness. altho i could get defected because the silencer is removable. on another note, my boss got defected for HIDs without reflectors and was fined 400, a little overkill on the fine isnt it? and they didnt give him a time period to drive the car home, they just made him ditch the car there and get a lift home. is that what theyre doing nowadays?

hahhaa i love the enthusiam here, i used to get worked up and try this try that but you know what the police always win right or wrong,
i have been epa'ed before on a stock car, but i still have to pay to have the test, i wrote letters everything they still win, defects back in the day where they had to give you 7 days they gave me 24hrs to clear it.......... went to complain i was told me smart son dont go against the police they can make your life difficult....
all i will say is good luck pay the fine and get on with it.
