hey guys
just wondering has anyone ever had an accident when someone has reversed into the front of their car whilst being in the car not stationary in a car park or anything but actually driving
i was reversed into at high point shopping center last friday and at the time the stupid girl said it was her fault said sorry several times and as of the next day she began to blame me and has now lodged a claim against me stating it was my fault...and now we have to send both our stories in and racv will decide who is liable,
has anyone been in this situation before if so please tell me your experiances and what the outcome was

yeh i kno i should of got her to write it down grrrr u dont think of these things it was my first accident i had no idea wat to do but i learnt my lesson i need all the luck i can get thanks :)
im gona go to high point tomorrow to try and get video footage of what happened as it was underground car park and if i can obtain that i am certain i can win

if you were stationary it was her fault.
also, if there was witnesses you should have written down their names
otherwise it is up to the insurance to decide.
But generally, if she was reversing it means you have the right of way so she is in the wrong.
Don't worry too much if she lodged a claim since insurance will decide who is at fault.

yeh i understand what your saying but she is saying that i drove up her ass...my guess is this...she addmitted fault on the day because she clearly knew it was her fault and they she went home after shopping and told her dad or boyfriend anyone someone got into her ear and said yeh u may of reversed into him but because he is behind you can blame it on him...
lol the dumb girl even offered me n my friends a lift because she felt bad...i have two witnesses who were in my car and saw it all unfold but im praying to god that high point have sum video footage to give me so i can prove this bitch wrong

i doubt car park would have much of a camera. Call her up and tell her that you had two witnesses, if she is found to have lodged a false claim her insurance won't even cover her for damages regardless of whose fault it is. Say that you will take her to court with witnesses in which case she will have to pay for court fee's/lawyer fees and if she was found for lodging a false claim she also has to pay for all damages out of her own pocket. See how happy her boyfriend and dad will be then.

well the two witnesses were the two people in my car so dont know how much help that will be racv said it will be fine...high point said they have video cameras in the carparks just i have to go and point it out where it happened.

yeha i had a simalar situation. This is what Just cars said:
if she reversed into you, then she is at fault. no way around it.
If you can just get her to admit that.
But after all that, the best people to ask is your insurance company.
just make it seem like a general enquiry.

Jesus Christ! you should of got her details and called the police or insurance company immediately after. what were you doing man? the driver at the back is always the one to blame. but good luck man. hope you get this b1tch. cheers

im going through all that crap now, the insurance company deemed my accident to be my fault (when it clearly isnt) but nothing they have for evidence adds up at all, its like they have the wrong file or something, iv got a good lawyer etc and wer sorting it out now =D

one of my girlfriends reversed into someone at a parking lot but she said she was at fault and even bought the woman a new license plate holder to call it even then the bitch lodged a claim saying my gf ran away at the scene costing my gf 2k and the womans car wasnt even damaged!!
if your car wasnt even on or was stationary you have nothing to worry about, they will sure be able to tell, let us know how it all goes!
i hope she gets in shit for trying to jack you with the insurance what a spitefull little rat!!
i just had a similar incident in my Integra, where a b1tch reversed into my drivers door while i was stationary.
They will probably get you to draw a diagram before and after impact, then call to confirm some details.
If she wants to be a mole and say its your fault, just say you were stationary when she hit you.

yeh i have said that.. i have to send in my side of the story and a diagram of the accident they said they can determine by the damage on the cars....my witnesses though r my best mate n my girlfriend bcuz they were in my car so i duno how much its going to help me.....its fukin hard i tell ya just why cant some people be normal and admit they ****ed up....i am 1000000% positive i was stationary i just want a camera to show it...

well i went down to highpoint today talked to security and because im young they want to help me which is good...there is a camera where the accident took place its a swivel camera goes from left ro right so im praying that its caught the accident when it happened they are goin to look 2moro and let me know i gotta call em tomorrow and they will tell me what they have found and if they do they cannot give me the footage but can tell me whos at fault and i will tell the police and the insurance company to sepina the info from them
hopefully i can get something to prove this girl wrong

well good news ppl, highpoint contacted me and said they have video footage of the accident :) but im not out of the woods yet its hard to tell apparantly because the camera is facing front on so it wuld show her car and me behind her so he said he rekons she hits me but his no expert but hopefully the insurance company will have better luck finding out its not my fault

call her and tell her there was camera's so basically she is already fuked for lodging a false claim and that insurance won't cover her anymore and may risk her insurance policy/insurance rates. That will scare her enough.

yeah, u can say ur out of the woods BUT there's always a but ^^, depends on the seriousness of this case and wat extreme measures it goes 2...
1. if u coped a smart ass prosector lawyer, he could bring up u being a reckless driver for not taking care when ur reserving in a tight car park especially when we're talking abt hp.
2. video footage...was unclear even if u brought it 4ward, it could be deem as useless n especially wat time n was it dark then it could be a disadvantage to you
3. the real problem is do u have sufficient eye witness due to their distance or any1 that could she said sorry immediately after the accident.
4. tapes recording of some1 is efficient because the judge can overrule the consent of the person being recorded and the record can be ur advantage.
these 3 points will be ur main disadvantages but yeah keep this thread going ^^....always love these court cases, ppl might think who i am XD...my brother major in international law, so i tend 2 read his notes =]

but ive seen the camera quality not the footage cuz wen the security officer had top find out which part of the carpark i was talking about...he bought me in and showed me the area i described and the camera shows colour screen and just straight recording...and it was daytime bout 7 pm cuz of lovely daylight savings....
im just praying the insurance company see's it my way

Similar situation happened to me a while back. A 4WD reversed into me whilst my gf was in the car (parked) and I went out to grab something at the shops nearby.
The 4WD hit the front and ran off. Gf tried get the mans attention to no avail but recorded plates. A store person who saw the entire thing unfold gave us his details to act as witness.
Went to nearby police station for a good hour or so, took pics etc and came to the conclusion that the 4WD driver had no idea it had happened.
In the end the insurance company handled everything. Lost the car for 2 weeks. Overall I was left in a situation with many hassles! Now my front bumper is a different shade of metallic grey! And they were going to charge me an extra $300 to colour code it properly with the bonnet.
Even with insurance, the experience is.... :thumbdwn::thumbdwn::thumbdwn:

i got smashed up the ass, and that flew me forward int othe car in front of me, but the girl that hit me up the ass had to pay the lot. so insurance was good to me
Don't worry too much mate, it looks like your holding all the cards at the moment. In terms of ammo, she's got nothing but words, no solid evidence or witnesses at all.
You on the other hand have two witnesses who saw the accident unfold, and also were witness of the girl admitting fault at the scene. You also have video footage of where the cars were before the crash.
Worse comes to worse, you'll have to hassle your friends into giving a statement, but let your insurance company do the work first, if that doesnt work then take her to court. She's got nothing on you.

lol i think your very lost in the matter of reading the evidence from this case. i think you need to consult your brother a bit more.
as for jayvtech good luck, hope the insurance handles everything correctly, if not i would like to see you whoop her ass in court (in this case be very mean and ask for compensation for time/monetary lost for travel and court expenses, compo for damage and she gets fines all over the place for making false statements and blacklisted from insurance company :D ) i hate people like this :P hahaaha

fukin insurance company called me and said i have to foward the video footage to them and i cant because im not legally allowed to recieve the footage.... i told them that and they said well we will talk to our client and so on so forth and apparantly she has a eye witness who the only person i can think of is the other bitch that was in her car. its so one sided though because they are going to take her side and because she lodged the claim GRRRRRRR i wana take this bitch to court if i lose but i dnt know if i ca afford all the shit

Then treat RACV like they are an enemy and complain, complain and complain some more about their treatment of you, and how you're being rorted when it was the other driver who backed into you etc etc. If you sit back and cop it sweet, they'll start thinking it's your fault.

mate ive been ringing non stop i had a go at them yestrday saying how long do i have to wait for her to send her friken side of the story in...its been a week and a half...when they told me i had to send it in i did the the next day the bitch hasnt done anything yet....its ****ed and all they say is well we will try contacting her if not we will send her out a letter...WTF racv should realise that why would i be so eager to get things over & done with if it was my fault i would be avoiding everything

I've just recently had an old lady reverse into the front of my car at around 25-30km/h. She also had a tow bar which spiked my engine.
She reversed out of her driveway and onto the road about 50m or so up the road on which i just turned onto and slowed to a stop, then suddenly just started hurtling down to road and managed to narrowly avoid hitting parked cars on the side of the road and went straight into me. Turns out she thought she had placed it into drive and proceeded to accelerate. I came to a complete stop, flashed my lights and beeped my horn but it was clear that an accident was inevitable.
Also when she emerged from the car she needed her husband in the passenger seat to get her walker from the boot, turns out she had weak legs and couldn't brake in time. Begs the question as to why she was able to keep her license if she suffered from weak legs?
So the husband then proceeded to blame it on the brakes since it was recently serviced and it was clear he wanted to get it over and done with before i had a chance to call the police. I made sure that I contacted the police and had a chance to wait for the police to ensure that I was covered. They also called in their mechanic to check the car and sure enough the breaks worked fine. Then he claimed that he shoved the gear stick into park which brought them to a complete stop and claimed that had i braked in time, an accident would have been avoided.
When the police and tow truck arrived, they assumed that I had caused the accident being a young P-Plate driver and proceeded to go to talk to the elderly couple first. Luckily though she admitted fault and that the collision happened right in front of a person who was kind enough to give me her details as a witness to the accident. The husband continued to proclaim him and his wifes innocence but when she admitted fault it seemed as though it was the end of the story.
The tow truck driver asked me if i had insurance and I said yes, so he explained to me the assessment process and said to lodge a claim with AAMI and that it looked a write off. So we exchanged details and went our separate ways and thought that it was going to be ok.
Got home and AAMI notified me that because I only had 3rd party, they couldn't lodge a claim. So then I had to somehow stop the car from heading towards the assessment centre the next day or else her insurer (GIO) might not cover the towing fees or the holding fees if they held it for too long. So i contacted the towers and asked to tow it back to my place and the price came to a rich $370 - $270 to tow the car from parramatta to their holding centre in north parramatta no more than 1km away and $100 to tow it back to my place (15km away).
Then i found out that on the contact detail form, telephone wasn't supplied because it isn't compulsary by law, so that left me f***ed in that regard. I contacted GIO to see if a claim had been lodged so i could give that to the police and they couldn't tell me a thing because of privacy reasons. Luckily though I visited her the next day and she had lodged a claim, and her husband still continued to protest that had i braked in time that the accident would have been avoided.
That wasn't the last of it though :mad:
GIO contacted me a few days later and offered me 2.5k for my DA9 as it was a write off. I told them to shove that 2.5k where the sun don't shine. The guy kept firm on the 2.5k and I asked him where he got the figure from, and he said that that was the amount he was told to offer me. I told him that the policy required for them to replace my car, he protested that it was a write off and that 2.5k was the offer. So i said to him to replace my car for 2.5k or pay me market value, which was 3.8-4.5k according to redbook. After 30 minutes of arguing we finally agreed to the amount of 3.8k
All I can say is that having an accident is bad enough, without insurance companies trying to rip you off at the same time.
Sorry for the long winded post but hearing your scenario just brought back this situation to me.

Message her and just say "you are basically making the situation worse by ignoring me as you are already not covered for insurance as you lodged a false claim and the carpark has video footage which can be shown in court, which, by the way, I am taking you to if you keep refusing to cover the damages"

I'll ask my sister later tonight (who's a lawyer) and see what options you have here. Though shes in commercial law, hopefully she can shed some light as to what you can do in this situation.

get ur mates to call because she wont recongise their voice and just tell her that uve got legal advice and your pretty screwed for falsing a false claim after you admitted to the accident being your fault. and also say that you have the shopping centres full co-operation and have looked over the video footage from the car park and it clearly shows its your fault..

thats what i thought but someone said to me today if u are fully covered they wil fix ur car and then find out whos fault it is...wasnt sure thats why i was checking to me i would think they would wait to see whos fault it is
Just tell her you have footage and YOU will lose if u try anything, you always have witnesses and if you are willing to take this further i.e. court where she will lose and because of that she will be forced to pay for ALL damages out of her OWN pocket and also her insurance rates and premiums will be fkd for life

so rang up RACV today and they said the other girl is yet to send in her side of the story however they have asked for the video footage and are going to see who is at fault

Record it on your phone - from now on. That will be good enough proof, provided the person accepts that they are being recorded, and they state their name and rego.

pwah next time im getting the cops involved straight away if not ill get em to say it on recorder and then write it down and sign it and i will make sure its the same signiture as the one on the license

Omg great news ppl.....racv went down to highpoint viewed the footage and the lady said to me it clearly showed her reversing into me....so they are covering me :)
omg you have no idea how much i was jumping for joy that justice prevailed..
i appreciate everyone on here making an effort to help me out as well....i hope this never happens to any of u guys lol
