hypothetical situation,
guy with a car hits your car, regardless accidently or purposely,
does a runner, u got the number plate report it etc,
evidence ( damage, witnesses, his car damage etc ) all line up and support ur case 100%,
say he has no third party insurence
what will happen?
do the police " make him pay"
etc?
how does this all work?

u have insurance urself? if yes, then give the details of the other party to ur insurance party and let them chase the guy...if u have a police report, even better to help ur insurance company...

its the job of your insurance company to do all this running around for you (contact police , chase up this other party , take to court etc)
Since THEY want to recoup all their money back from repairing your car and legal fees etc

so wonder why nrma didn't do it for my mum...
mum got plate of a car...police didn't do crap to visit the address of the number plate...
apparently nrma need the details of the person..number plate alone is not good enough?
my mum would like her $500 excess back ......
;)
what are the cops doin...?

if ur mum gave the number plate to the insurance company (assuming her car's insured), and say that it's a hit and run, then the insurance company can try to find out the details of the car's owner...

no no no ,
none of that
its a purely hypothetical situation,
if u guys read the story i wrote about the racist australian guy it is linked to that
when he went back in his car he put his reverse lights on and for a moment i thought hed start ramming his ass into my front bumper, but he didnt
and i wodnered, what if he did?
obviously at that moment id note his plate and i ahd witnesses in the car etc,
but what if he didnt have insurence?
TO MAKE IT SIMPLIER
say i went to ben's house
and decided i didnt like him for whatever reason and i did something bad to his car with my car
and i legged it
and he calls the popo boys and they come over and i deny it but suffecient evidence says i did do it
and they say u pay for it son
and i say ok (but lying)
and i never pay ben, and i dont have insurence, and lets say i did so much damage i couldnt repair his car cause i dont have enoguh money unless i sell the house or something,
WHAT WILL HAPPEN? how will ben recoup his loss's

i think it's for the best interest of the insurance company to use every means available to them to get the details of the other party, because the accident wasn't ur mum's fault in the 1st place...unless they want to cover the repair cost by themselves...
maybe other members that work @ insurance company can help in regards to this matter?;)

Hypothetically , people CAN get away with such a situation - i have been told by family of "dead beats" that drive with no insurance no money no care and have been hit and theres nothing you can do (they are declared bankrupt etc) but this is worst case scenario.
BTW by saying "racist australian" you are racially sterotyping :) Remember living in this country makes you australian too :)
In your hypothetical situation i will recoup my loss by finding you and putting a screwdriver thru your eye socket into your brain :) rofl.

If they know who you are, they take you to court.
If you still don't pay up then the marshall will come to your house and reposess valuables/property from you and sell that to make up for the damage you did.
If they don't know who you are but they got your plate, they'll find out who you are then take you to court anyway. :D

ok...
Person B (victim) needs to make a Claim through his insurance company and provide a police report. Depending on person A's insurance company provider they may cover up to $5000 in damages caused by an uninsured vehicle so long as you have their details and then the insurance company takes care of the rest i.e. taking person B to court. If person A's company does not have that bonus cover (and person A's only has third party property Damage cover) then repairs will not commence until the finalization of the court appearance, were as with comprehensive cover you fork out the excess and have it refunded to you when you finalized the court details.
One way or another if Person A has enough details the insurance company will look after you.. and Person B is stuck with the bill for repairs

sorry to bring up thread again.
so if person B (victim) has no insurance, and person A hits them (regardless of being insured or un insured) does that mean, you personally have to take them to court for anything to be done about it? otherwise they can just run away?

Pretty much, but thats why its important to get a police report done at the time of an accident, so there is some basis to work off.
If Person A has insurance then it makes things easier because will accommodate for the repairs and you don't have to speak to Person A.
