Hey I recently bought some items from OH from a private seller... and he has like some positive feedbacks and i've successfully dealt with him before twice!.. But then this time... the item never came... he apparently forgot what day it was sent when I asked him the week right after.. AND HE LOST THE POSTAGE RECEIPT and ignores my PMs. It's been almost 3 weeks from Melbourne to Sydney.. it shouldn't take that long. What do you recommend I do? Department of Fair Trading? Police?

well to be honest, we cant really do much. We aren't a governing body on who buys and sells (like eBay with buyer protection). We only provide the medium for the sale to happen and the rest is up to the buyer and seller to work out.

The only way we can intervene is if this happens to several people , and we can disable their selling priviledges.

The only thing you can do is leave corresponding feedback so that other buyers will be aware of this situation.

two words

dart...gun

but seriously, i think u might just be s.o.o.l. next time use ebay or something with security measures, or buy locally. or just not from that person, its part of the risk u take dealing with anyone

Hmm yeh but you know at this stage he hasn't replied and his mobile is on message.. there could be explanations I just don't want to name the person as yet.. Maybe he will refund also so yeh I'll have to see.. and yeh like the thing is i've dealt with him twice. I'd just have to wait... if nothing by coming monday ( over 3 weeks since payment ) it's name and shame time... so no government body can help?

Reckon it's a scam at this stage? over 2 weeks and replied only at one stage and didnt reply to last 3 PMs and I saw he was online on OH (green light and public profile), phone is on message box, "lost" the tracking number in a few days, doesn't remember what day he sent it and it's 3 weeks now. hmm it's holding my car up.. it's supposed to get painted like soon because this was supposed to be the last part.. but no this is holding everything up.

No do NOT publicly name or defame.
This is not on and you will get infracted.

There is little "mods" can do apart from help out in any police investigation (should it reach that level). All YOU can do is submit bad trade feedback and hope another doesnt have to deal with this person.

Since you've delt with him 2 other occasions, i'm guessing you have the sender's address.. If the part is worth a fair bit of money and you really got scammed bad, then take matters into your own hands, and pay him/her a visit =)

im sorry to hear about that man...
sometimes its not worth seeking legal advice if the amount you've spent isn't much at all...
whenever i trade on OH i try to keep it within my state to avoid these things happening...
hopefully you didn't lose out on much man...

RtN
10-09-2008, 07:04 PM
Nah man I didn't lose too much, but yeh umm money is money, why should you give it away for free? And when you need an item for your car.. and you pay for it and it doesn't come? It is enraging especially when your whole car is waiting on that item. What happens if it was something much more costly... ? Phew lucky i didnt name and shame lol. And yeh thanks guys but all that stuff isn't worth it... I see what the authorities can do.. on Tuesday. If not i'd have to sleep on it. BTW thanks guys!

That's not good to hear. You never know there might be a good legitimate reason. Things do tend to pop up from time to time. Hopefully the part arrives at your door soon. If not, take it to the authorities.

why does OzHonda protect the rip off merchants but do nothing to help those who have been ripped off.

what are you so afraid of

The only reason why theres little mods can do is because you dont want to do anything about it.

May I suggest rather than trying to suppress public opinion and freedom of communication, you send a message and ban these dicks that are ripping off other members, as opposed to handing out infractions.

We all know of scumbags that are ripping people off, but its only once it has happened two or three or more times.

Yeah its caveat emptor out there, but what is wrong with stating the facts:

I purchased _ _ _ _ from _ _ _ _ _ on 01/09/2008 for $65.00 and I have received nothing.

People dont just make up these claims from thin air.... There has to be a reason...

Y not start a thread where ppl can request the user name be PM'd to them.
U'r not defaming them publicly that way and ppl like this shouldn't get away with sh*t like this.

First fill their inbox!!!!!

bennjamin
17-11-2008, 05:49 PM
tell the police of your case. Ask myself or Wynode for more info to assist with the police inquiry. Apart from that ,, there is to be NO public defaming until proven in a court of law.

and who determines whether it's true/untrue ?

a court of law - as hairy-ben said

if it was found he wasnt in the wrong and he gets name and shamed you got get completely ripped with defamation if he really was vigilant, so careful yo

same reason by the government has to be 100% sure to name and shame those restaurants on the department of health's website, imagine if they got it wrong! the implications would be horrible for the owner of that restaurant

Nothing you can legally do, which is why if you are in doubt, you need as much details as you can about the person before you buy. Speak to them on the phone, get their full name, address, serial number, blood type, whatever. Shifty people don't like giving out details except bank account numbers. Shame that someone with many positives can do this though.

Cost of legal process isn't worth the trouble.
Defamation from Ozhonda, could likely close the place down, if the person wanted to be a pain.
Also mail does get lost. I rem that postie who stole packages from people in Today Tonight.

Your best bet is to leave negative feedback on the guy.
If the mods believe that you have been wrong the best they can do is ban the guy. I don't think that will help much as he will most likely just register with a different name.

Based on what you've said i find it highly unlikely your getting your money back.

Even EBAY doesn't have much options unless you use their paypal.

Cops - unless it is something big they are not even gonna bother with you. I reported a car for having unusual engine stamping, and the owner not give back a refund on the item & they pretty much said they can't do anything about it. Didn't even bother looking into the matter or the stamping!

P.S Ben doing a /whois may not get you wat you want as they may not have give their correct name/details

So always do your homework before buying

hope he gets whats coming to him!~

seems at this point, whats coming to him is funds....hmm since more than one member is in the same situation, he is running a scam..supported by the fact there is no means of communication.

maybe there should be some sort of dispute thread, like how ebay deals with problems. alot of the time, there are reasons but lack of communication cause the problems. in this case, the seller seems to be in the wrong.
