Minister for Roads Michael Daley today met with representatives from the 4WD communityand car industry who asked for the introduction of proposed vehicle modification rules to be delayed and for more time to consult.
Mr Daley said he agreed to put the rule changes on hold and that more consultation was needed following the meeting.
Ive listened to feedback from the industry and the community, and have agreed to set up a working party to look more closely at how we are going to address this road safety issue, he said.
All of those who attended todays meeting agreed that safety is paramount and that unsafe modifications of vehicles do need be stamped out.
The working group will include representatives from the NSW Centre for Road Safety,
Four Wheel Drive NSW-ACT, Australian Automotive Aftermarket Association, the Australian 4WD Industry Council as well as other agencies and experts, Mr Daley said.
Executive Director of Australian Automotive Aftermarket Association Stuart Charity said this was a terrific outcome.
Were passionate about road safety and we understand the intent of the regulation is to make the roads safer he said.
Were looking forward to working towards a practical solution that meets road safety objectives while also taking industry views into account, Mr Charity said.
Greg Redfern from Four Wheel Drive NSW-ACT also welcomed the outcome and said the working group would have their full support.
We want to eliminate unsafe practices in the driving community and well work with the government to make sure these new regulations meet those objectives without any adverse consequences for the motoring community at large, he said.
We all agree that there is no place for extreme and illegal modifications, but the clubs in our association follow a strict code of conduct and ethics, and we want to make sure theyre not punished, Mr Redfern said.

Are you serious? A drag strip is exactly what you're describing such as WSID, open at night and cheap to run, where you can speed off the streets. You're pretty much describing what has already been said and done, these laws are introduced because of people who think it's cool to break laws, the government doesn't need to make a super cool place for people to speed off the street when they shouldn't be breaking the law in the first place.
alright im pretty sure people modding there cars arent doing it becoz its cool to break laws... rather becoz they want there car looking better or going faster... and WSID is open n watever on wed nights n saturdays to the public... im saying something open to the public every night . . .

ha ha lol i have all my defects next to my engeineers papers for my car, even after getting my car 100% legal and inspected over the pits i have been defected 3 times after that for major items and had to have it passed over the pits and every time it passes, followed by (ha ha see you in a few weeks agian and a wave) i mean the last time i didnt even have to take the car!!! this is at the RTA pits mind you not some dodgy bob place!!
just goes to show that even after i do the right thing and spend the money and time getting my car right and legal to drive on the road i still get pulled over and picked on! and for things that are listed on my certificate! feels like the biggest waste of time and money getting it!
i hold a good record for being Defected getting pulled over and defected agian (so defected and defected while defected) getting pulled over 2 times within 7 mins and 5kms getting pulled over mind you for "RBT" in my own street 2 on seperate occasions being defected while parked and in the car and then another time defected while the car was parked and i was watching the waves on the beach.... :)

I think moey means like a place that is like government advertised , enforced etc , so they can be like instead of drag racing on the street go dere n stuff. Also a place were car enthusiasts can go on friday,saturday and sunday nights instead of going Lapa or Brighton and getting targetted n defectedd ass rapped by coppers etcc.
Just remember that an engineering certificate does not prevent defects, it simply makes the process much easier to have them cleared.
It's possible it could all be in the attitude you approach a cop with, but I guess that's just the risk you take when it comes into modifying cars.
depends man... wen i used to drive my mates highly modified EJ8 Coupe (showcar) the coppers were so rude to me, would like try and say stuff about the car to get me to get angry lol. they were like "oh how much u pay for this shitbox" im like yeah its a shitbox, confusing them lmao...and yeah they still defected the car even with everything engineered or would find really stupid defects, like different bulbs in the dash lighting etc.

Lookingforboost, while you have made some valid points, you have to realise that defects are defects, irrespective of engineer certificate. The certificate is not a get out of goal card for the popos.
You say that HWP sould get a life, well just to enlighten you, the role of HWP is just that. Traffic related issues, which funny enough included defects and issuing traffic related fines. That is their life!

^^ Correct. There are some popos out there who will give tickets to their grannies and there are ones who will cut you a bit of slack if you shoe some "respect".
Short story......A good friend of mine a few years ago had a reasonably modded car. He had an engine conversion etc.... One night he gets pulled over by the popos for having yellow headlights (not legal). The popos were reasonably nice saying to him, "You know you cant have yellow lights?". My mate goes, "Mazdas have them stock, what are you taking about?". Popo goes, "Well, we're not dealing with that particular mazda, I'm referring to your car". My mate, "Well I hope you get all the other car with yellow lights then!".
The popo then gets his defect book out and writes up everything from too low to not having a shiftboot cover.
Moral to the story......Show respect! All my mate had to do was o tsay along the lines, Sorry, I didn't know. I will head home and fix it or something like that! The popos was not looking to defect his car. He was very nice in his approach and in my opinion, was simply informing my mate about his yellow light!

mate got dicked on springvale road, is there such thing as a fine for passing the white line (the big white lines before the pedestrian lines) at the traffic lights by a little bit and another fine for unsafe parking when you pull over cos the cop made you stop on the side of the road? i think the cops around springvale are just meeting their quota atm and its pure revenue.

well, to all you out there i'd take down the cop's badge number & name and report the incident to the police obudsman. If enough of you complain after a while they will get the message that they are actually not in the right.
I've had my share when i was younger and i almost took one matter to court, spoke with the local magistrate (friend's dad) who agreed with me that what happened was a load of crap, ended up being cheaper to pay the fine. Its tough at times, and especially with the current government spending all the surplus, they have to raise revenue. Young drivers with hotted cars are good targets cos they think you've prob got abit of $$$ to pay with
Most cops you will find do not know the laws well enough & play on young drivers being just as ignorant.
I've tested some at the local police station before. Unless you take it to court its your word against theirs and yours doesn't mean jack.
im so sick of anything to do with cops and defects these days and i know there is nothing i can do about it....
even if my car was legit height etc etc i know i'll still be targeted so you just have to deal with it.
i have to go out of my way to stay off main roads to get anywhere in the city just because of stupid crackdowns.
one of my mates got defected for too low the other week and they told him that his rear LCA bushing was worn and to fix it. he fixed it that day and took it back and the same engineer said he fixed the wrong thing, later pointing to the rear trailing arm bush and saying that its the same thing! how can someone at the main RTA pits in canberra not know the difference...? at the same time they asked what kinda of suspension he had (cusco zero 2). it seems as if there is no knowledge possessed by half of these guys...
long story short...i'm utterly sick of how often me and my mates get defected and just used to it now, only thing you can do try be polite when getting pulled over (even though your head is about to get blow off from rage) or have a stock car otherwise u just have to deal with it that having a modified car in any way sooner or later u will get caught

I agree that it is all BS but police dont need three things to give you a major defect. For example:
Too Low is a major defect itself, no other problems needed, Anything the cop has missed will be picked up when you get the roadworthy.
Small things such as a cracked indicator, blown globe or a chip in the windscreen are MINOR defects. if you get three minors you have yourself a major.
As for the stiffness thing;
Your vehicle is supposed to maintain 2/3rds of the factory suspension travel. This is not a new bs law. I have been defected many times for it. If your car is uneven (front higher then the rear etc) you will get a defect.
When it comes to fines, the police officer will write down the first thing that comes to their head. Generally when you get a fine along with a defect it is for driving an UNSAFE vehicle. Im sure if you contested the Modified vehicle fine it would fall under the unsafe vehicle category and you would still have to pay.
In saying this, I feel as it is getting rediculous with all of the bullshit new fines and laws around, makes my blood boil.

So the story goes; I was driving this home from dandenong:

It was around 2am, I had just dropped off a mate to pick up his car. Princess hwy, I get pulled over by an unmarked holden astra. The cop walks over and says, "the reason we pulled you over was because we heard your car scraping on the ground!" I replied, "I seriously doubt that officer." The car was 100mm off the ground at its lowest point in the rear, front was still 4x4 spec.
After 20minutes of them laying on the ground with their "wheel" they couldnt hit a single thing. At this point I was in tears laughing, but I made sure they didnt see me. They were furious, went over the whole car and all they could find was a cracked indicator lense, windscreen washers didnt work (I said no water but really there was no bottle :cool: ), the vehicle being uneven and it didnt retain 2/3rds of the suspension travel, mind you at full height it was the same stiffness which is why that rule is bullshit.
I thought alright, Ill get a defect, maybe a fine, Ill have it all clear in a few days.

He came back, slapped a yellow sticker on it, handed me the defect paperwork and a fine for $187 for driving an unsafe vehicle. What happend next almost sent me to jail for life.
I said, "so thats it then?" to which he replied "pull the vehicle over to the slip lane, we will follow you, then you cannot drive the vehicle." "Excuse me??" I replied. "You heard. You have to tow it home, if we catch you driving it you will be charged and prosecuted." "I live in reservoir, we are in dandenong. How do you suppose I get home at 2am? Its not a 5 minute walk, Its over an hours drive!" To which he replied, "Thats not my problem." and smiled.
As you could imagine, my head was about to explode, I felt like de-bowling him and making him eat it.
I didnt have my mobile on me, only had 50c and had no idea where the f@#k I was gonna find a payphone so I asked "Can I use your phone? can you call someone for me?" He laughed, handed back my licence and said have a good night.
Two days later I returned with a trade plate, drove it all the way home. Long gone now, but was an experiance I wont be forgetting anytime soon. Once my civic is back on the road Ill be sure to carry a large tub of vaseline.

I've been pulled over quite a few times now especially for 'random' breathe tests... heck even at 7.30 in the morning!
Most surprising was the latest incident when I was pulled over straight after heading out of a shopping centre carpark at around 8pm. The coppa comes around and asks me "do you know why you were pulled over?",
I reply nicely and said not at all, he then explains to me the biggest bs i've ever heard and tells me that I had apparently cut a bmw off whilst coming out of the shopping centre.
There was obviously no bmw since the cop was right behind after coming out of the carpark... however i resisted to argue. He then further asks if i was on the phone etc etc
After a while he asks where im headed to and lets me go. He then proceeds to follow me to my destination (wtf?)
So far been very lucky that whenever i've been pulled over it has been in a very dark area or when im suited up going to work, so no defects and fines so far touch wood :)

it's BS you guys get all these problems. I've been living in QLD for over a year now, originally from NZ. I lost my license for 6 months back home because I pulled out of an intersection with my mate in the car, nailed it from 1st to 2nd, and a cop came past and did my for some boy racing law. Complete shit that I would have argued had I not had a few beers and would have been over the limit. So used my skills to actually make him forget to take a breath sample from me...holding the breath meter thing in his hand as he jumped out the car.
Ive been a good driver here, got my little civic with not too much power.
But I have to say, the only time I got pulled up here was in a car with no rego, my mates car of all things, but it was rego'd it just hadn't been received and he was also new to Australia. They were nice to me, said it's rego'd, just take the old one off as that's a fine here. Let me on the way, maybe because my mate is an older guy and we didn't look like racers.
But I definitely feel cops use personal feelings and human emotions to pull over people and react. Which really, they should be hooked up to a matrix machine, have all their thoughts wiped from memory and be programmed to only use the law and be matter of fact, no personal feelings...sure this will never happen, but that's the problem people face.
Has anyone in teh Gold Coast had bad run in with cops for no real good reason...and I don't mean like my mate had getting busted going 270 down the M1 and escaped jail time with a good lawyer. I mean driving along, and get attacked by cops yada.. To be honest the only time I really see cops pulling cars over here are if you have a Suby or Skyline.

there was a report in the hearald sun the other day (sunday i believe) with an ex 'oldie' cop saying cops should go back to they way they used to be before, concentrating on 'real crimes' not speeding/hoon laws driving around the street booking people while other more serious crimes are happening and getting away. Of course, this 'old' cop got crucified.. story went something like that.
Not much you can do now.... Back then there were "cops". Now you have "general duties", "highway patrol", "detectives". They are specialised now that you can't ask a highway patrol cop to become a detective and solve crimes. So the highway patrol cop keeps doing what he does best. Catching people for speeding and pick on modified cars.
BTW, latest use of the word "hoons" on the news was for cars with extra loud sound systems just cruising the streets slowly. I think this was Channel Nine, it's the channel with the old guy as a newsreader.

haha not much can be done when not even myself can say what my real limit was. but i should have said the drinking laws are different in nz and because i was skinny i felt the couple of beers i had were probably near what is an acceptable limit for my size, so i thought perhaps i was just over limit, but i didnt want to take that chance. but yet ive seen my mate drink like 8 beers and not be over the limit so really no concern from me my friend. but thanks for the heads up.
and do agree, was going to say, cops should be focussing on other issues. 3 murders in burleigh gold cost in 7 months said on news last night, made me thinkg really lots of more hardout crime goes on.
but in all fair ness to the cops around here, my general run in with them has been reasonable except for 1 cop at indy trying to get me for jay walking. i just think because ive had my run ins and now try to lie low key it has worked, but no doubt if i got some 20"s, lowered, did a few things to make me more attractive i would no doubt expect to get pulled over...yet being pulled up should always be random, no targetting which unfortunately happens when the government and media hype up certain issues....the big issue this decade has been boy racing..thanks fast and furious :(
i usually find it pretty successful to be very polite to the cop even if you want to go hectic on him and snap his neck, they usually respect you back and let you off.

I've worked the industry and lowered with chop springs is a fairly common practice, so your statement of lower to ground = better is not necessarily true.
Other than that I've had no problems with police, I drive sensible with a lowered car on p plates and I live right down the road to a police station.
Courts are generally in favour of common sense and law. The people who dont get it, usually dont get the law!
Just remember that everyone has the right to make a formal complaint if they feel they have been inappropriately dealt with, whether it is by a cop or council worker etc....its easy, find out what station they're from and talk to the superior about what happened.
Remember, people find it hard to be objective in the heat of the moment!
They do have different roles now, but I think they (government/police, whoever puts them into the specialised forces) have been focusing too much on the highway patrol section. I see highway patrols, and unmarked cars everywhere, surely they don't need that many of them. Time to re-train cops to do other work too.
But with that said, I haven't had any bad experiences. Actually all my experiences have been pretty good. All I've had is a little mention that my exhaust is too loud, nothing about my ride height.
That's because the highway patrol are the ones that roam the street. General duties and detectives only go from station to the crime scene (and to get a donut). They are usually parked at the station car park. So we will see many more highway patrol cars than general duties cars on the street.
damn flu, can't get to sleep, but anyhow while i do agree some cops may be a bit annoying sometimes, but bear in mind that they have to deal with all the bs while we go on with our merry life's. I know of a few, they're pretty reasonable people, just last Tuesday night while one of them was on duty, while i was chatting to him, a call came over on his radio, a pedestrian was hit by a car. At that moment, i was glad that it wasn't me that had to deal with that mess. Another cop told me that he had to leave because of what he saw when he arrived at an accident where a young family was involved in. So yeah just my 2 cents, sure sometimes they are pricks, but they're the ones that are willing to deal with the mess when most of us aren't willing to do.

As someone else stated earlier, we should carry a copy of the laws/legislation in our cars so when we do get pulled over we have 'legal' facts to support us. These 'fresh' laws are getting out of hand... As law enforcement officers, are they not required to show us the law in which we are breaching? The police do not have the right to walk all over us, and we can't be scared to speak up or against them. Less we not forget that we have rights as citizens! Just maintain the respect when you speak with them, and between each other... :)

Copper got owned when trying to defect him, since they auto level themselves, HID's are at 4000k.. Just pure GG :)
Thats terrible - i would seriously look into the laws for anything that specifically asks for "suspension rates/stiffness rules" and youll probably find hes just made it up. Also its like speeding - they have to get proof of you speeding on the radar to fine you, your cop mate did a simple push on the car its too stiff test - wheres the numbers/data to indicate that it is too stiff (if there even is such a law)
My last couple of run ins have been a cop who specifically said i was doin 72, yeah actually said "i reckon you were going 72" when i seen the rbt station coming up ahead and rolled up to them. Then the same cop pulled me over for a rbt and licence check - then asked me if my car has a BOV lol. I get soooo frustrated because i drive sensibly (now) but because its a yellow sports car with a wing i get targeted.
Everyone keep your wits about you the next couple of weeks because of the holiday season, double fines and demerits, stay outta trouble so we can all enjoy our cars next year.
