I think in qld even carbon wrapped components (or fully carbon products) are illegal as if you were to hit a pedestrian they shatter and will cut you, getting hit by a car wont hurt you but the carbon will cause a nasty cut. Fairly positive on that one. They may differ from state to state - where abouts are you?

Doubt it or at least noone cares. I have a cf side mugen wing on my DC5 and it's fine, especially because it only has the cf tips. Had a full cf one on my Jazz and never got asked about it.
