    if you are not at fault you do not have to use your insurance company to claim damages, they act as an agent. You can also use a lawyer.

    A lawyer will
    1. Independently value your car - the benefit is that insurance companies get their cars valued by their own assessors and usually value it lower to minimise payout fees.
    2. Cost you nothing - lawyer's take a proportion of what they claim from the insurance companies. Therefore it is in their best interests to claim back as much as they can on your behalf. They will include their own fee in ADDITION to what they claim back from the other insurance party.
    3. They can and will likely also include things like stamp duty etc.

    When i got hit by a drunk driver in 2004, i went with a lawyer instead of Just Car Insurance. I cancelled my insurance policy once it was deemed that the accident was not my fault and was refunded the balance of my premium. I then contacted a lawyer who claimed back more than market value for my 1996 Integra VTiR because of the low KM's and immaculate condition. They also negotiated a buy back of the wreck on my behalf (my request) and claimed, rego, transfer fees, stamp duty etc for my new car. IIRC their own fee was about $800, which they too claimed from the other insurance company.

    Know you rights, you have a lot, especially when you have done nothing wrong.
    If you stand for nothing, you will fall for anything.

    I would personally steer clear of using lawyers and continue with your insurance company - That's what you pay them for.

    The car is within 10 years old and

    Continue to negotiate with Budget, Have a look for similar vehicles on carsales for a 04 euro lux and present that to budget direct.

    I've also got access to the glass guide via work - I've done a valuation with 120k on the clock.

    So, via the glasses guide, 15k is a reasonable payout. The redbook/glasses guide is a guide ONLY. Use the real sales of the market to negotiate a payout for your vehicle, like carsales ect - Budget are going to recover the cost anyway.

    Mine was a Euro Lux Sports. ie. had the factory lip kit etc, as well as all lux features.
    Should be a few thousand more.

    anyways, the insurance companies are sorting it out. they can take their time.

    if anyone spots an 04 euro lux sports for $14.5k, let me know. i need a replacement! thanks.
    $500 to pay for transfer and stamp duty.

    i was working for a honda dealer in 2004-2005. i am not sure if there was any Luxury Sports. It would have been Luxury with additional accessories fitted. so, you should point out to the insurance company that those body kit costs quite a lot.

    Just be careful for Insurance company that doesnt want to pay you enough for write off car because they cant sell the car afterwards under the new law:

    Yeah, there was no Lux Sports model. It would just be a Lux with body kit option fitted.

    Normally your insurance policy should record any expensive options such as the body kit, as they affect the value of the car, and can affect your premium. You might be in for an argument with the insurer if the body kit wasn't listed on the policy.

    how much do you guys think the salvage value would be?
    anyone interested in any CL9 parts? ie. motor, gear box, leather seats, airbags etc.. or the whole car as it is.

    although it's been a while, thought i'd let you guys know how this went.

    got paid out and got a later model VW Jetta instead.
    was surprised by the standard equipment this car comes with standard. ie. auto rain wipers, auto headlights, reverse parking sensors, auto dimming rear mirror, etc.
    handles great, a little more omph than euro and better fuel economy.

    worked out well in the end i guess.
