Is it foggy on the outside or inside? If on the inside, then only way is to separate the headlight halves apart to clean. If it is on the outside (feels rough too), then it just needs a fine sanding, polishing and then a coat of UV-resistant clear coat. Common to have to do this on cars that are nearing 10 years old. It is possible that the clear headlight is newer than the foggy one as it may have been replaced in the part prior to you purchasing it.

I got a hold of the insurance company again and they said that they replaced one headlight in the accident (no idea why the hell they did not replace the other one..) and they said that there was no damage to it
